Welcome to cynchracing.com (the "Site"), operated by Cynch Racing ("Cynch," "we," "us"). By using the Site you agree to these Terms.

1. The Site

The Site provides motorcycle-racing coverage, timing results, photo and video galleries, a racer directory, and a community bulletin board. It is intended for users in the United States.

2. Accounts

You are responsible for your account credentials and for activity under your account. You must provide a valid email address. We may suspend or terminate accounts that violate these Terms.

3. Your content

You retain ownership of content you post (photos, videos, listings, text). By posting, you grant Cynch a non-exclusive, royalty-free license to host, display, and distribute that content on the Site. You represent that you have the rights to anything you post. We may remove content at our discretion.

4. Acceptable use

Do not post content that is unlawful, infringing, deceptive, harassing, or obscene; do not attempt to disrupt or gain unauthorized access to the Site; do not use the bulletin board for scams or spam. Transactions arranged through the bulletin board are strictly between the parties involved — Cynch is not a party to, and assumes no responsibility for, any such transaction.

5. Racer numbers & timing data

Racer-number claims are provided as a community convenience and do not confer any official status with the MRA. Timing and results data is official public data published by MYLAPS Speedhive; we present it as received and make no guarantee of accuracy.

6. Disclaimers

THE SITE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MOTORCYCLE RACING IS DANGEROUS; NOTHING ON THE SITE IS ADVICE OR INSTRUCTION.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYNCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

8. Indemnification

You agree to indemnify and hold Cynch harmless from claims arising out of your content or your use of the Site.

9. Governing law

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. Venue for any dispute lies in the state or federal courts located in Colorado.

10. Changes

We may update these Terms; continued use of the Site after changes constitutes acceptance.
